Terms of Service

These Terms govern your access to and use of chinchilla.marketing, the downloadable builds we sell, and any marketing automation, content, or development service we provide. By using the site or buying a build, you agree to them.

The service

Chinchilla Marketing builds always-on marketing pipelines and productised content. That includes:

• Downloadable builds — instruction files (delivered as .md) that describe how to reproduce a specific video, image, or page output, sold at a flat price shown at checkout.
• Agency services — websites, video, music, bots, and automation built to order.
• This website — the pages at chinchilla.marketing, including demos and documentation.

The work is delivered, not taught. A build is an output you can use; it is not a course, and it is not a promise of any particular commercial result.

Purchases, pricing, and payment

All payments are processed by Square. We do not receive or store your full card details. Prices are shown in US dollars at checkout and may change at any time — the price you paid at the moment of purchase is the price that applies to that order.

You are responsible for any taxes, duties, or fees imposed in your jurisdiction, and for providing accurate billing information.

Delivery

Digital builds are delivered by download after payment is confirmed. Delivery is normally immediate, but if a link fails or a file is missing, contact us and we will re-issue it.

Refunds

Nothing here removes any right you have under applicable consumer law.

Licence and permitted use

When you buy a build, you get a non-exclusive, non-transferable licence to use it for your own personal or business purposes, including in work delivered to your own clients. You may not:

• Resell, redistribute, or sublicense the build file itself as a product;
• Publish it as your own template, course, or downloadable; or
• Use it to build a competing library of builds for sale.

Outputs you generate using a build are yours to use commercially, subject to the terms of any third-party tools the build relies on.

Your content and inputs

If you send us material — footage, images, audio, text, brand assets, access credentials — you confirm you have the right to use it and to let us process it on your behalf. You keep ownership of your material. We use it only to deliver the service you asked for.

You are responsible for making sure the content you supply does not infringe anyone else's rights.

Acceptable use

You agree not to use the site or our services to:

• Break any law, or infringe anyone's intellectual property or privacy;
• Generate or distribute misleading, deceptive, defamatory, or harmful material;
• Impersonate a person or organisation in a way intended to deceive;
• Probe, overload, or interfere with our systems, or attempt to access them without authorisation.

Third-party platforms and services

Our work often runs on platforms we do not control — including Square, Cloudflare, Google, Meta (Facebook and Instagram), Telegram, and Discord. Your use of those platforms is governed by their own terms and policies, not ours.

We are not affiliated with, endorsed by, or sponsored by any of those companies. Where a build or service integrates with a platform, that platform may change or withdraw access at any time, and we are not responsible for those changes.

Intellectual property

The site, its design, its text, and our own tooling and pipelines are owned by Chinchilla Marketing and protected by applicable law. Nothing in these Terms transfers that ownership to you, except the limited licence described above.

Availability and changes

We may add, change, or remove features, builds, or pages at any time, and we may suspend the site for maintenance. We do not guarantee uninterrupted or error-free availability.

Disclaimers

The site and the builds are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that a build will produce a particular result, reach a particular audience, or generate any revenue.

Limitation of liability

To the maximum extent permitted by law, Chinchilla Marketing will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of the site or our services.

Our total liability for any claim relating to a build or service is limited to the amount you paid us for that build or service.

Indemnity

You agree to indemnify and hold Chinchilla Marketing harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the site or services, your content, or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version, and continued use of the site after a change means you accept it.
